Update: June, 2008, Volume 3, Issue 2
Dear Friends, In this issue of our newsletter, our Featured Fact is on the many sightings of Laci the morning of December 24, 2002 and the lack of police follow-up on those sightings. We also have included a link below to a Modesto Bee article from Tuesday, June 03, 2008. A hearing for the wrongful death lawsuit against Scott will take place in Modesto tomorrow, June 6. Judge Roger Beauchesne will rule on whether Scott's guilt must be proven in civil court or whether the guilty verdict from criminal court can be used. Since Scott's criminal verdict is under appeal, our attorneys maintain that the criminal conviction should not be able to be used in civil court. Last Friday's court ruling…
In the wrongful death civil lawsuit against Scott for monetary damages, Judge Beauchesne ruled in favor of the defense last Friday. Scott was granted a trial in civil court.
A ruling against Scott would have meant that he would automatically be ‘guilty’ in civil court because of the guilty verdict in criminal court, and only a monetary award would then be decided in the civil case. The ruling is favorable for Scott, indicating there are issues that merit being re-tried.
Yesterday’s decision can be appealed, but will most likely be upheld in higher courts since it was a fair and impartial judgment in accordance with the law. The appeal process for this decision will be completed by June 23
rd
.
Although the trial is scheduled for July 8
th
, it is common for depositions to take place prior to the trial. These depositions must be completed 30 days before the trial begins.
So the July 8
th
date will probably be moved back.
We are thankful that this civil trial will provide more opportunities to expose the facts of this case and the truth out about Scott’s innocence.
