Monday, December 23rd, 2002

5:45-8pm

Scott said:
He and Laci went to Salon Salon where Laci's sister, Amy, works. Amy cuts Scott's hair. Scott and Laci picked up pizza on the way home from the salon at Mountain Mikes.

Featured Facts:
Amy Rocha confirmed the above to be true and added that she showed Laci how to "fun flip" her hair with a curling iron. Amy testified that Scott invited her over for pizza that night. Amy declined because she had plans with a friend. Scott indicated to Amy he had plans to go golfing in the morning. He told Amy that when he was finished golfing he'd pick up a gift basket for Laci and Amy's grandpa at a store called Vella Farms. (See Amy Rocha testimony)

8:30pm

Featured Fact:
Laci calls her mother, Sharon Rocha to confirm plans for the next day. (See Sharon Rocha testimony)

8:30-10:30pm

Scott said:
Scott said after Sharon's phone call at 8:30, they watched the rest of the football game then watched the movie "The Rookie". Scott estimated they went to bed around 10:30. Scott said Laci wore his blue pajama bottoms to bed "because they fit her".


Featured Facts:

As outlined in last month's "Featured Fact", the pants Laci wore to the salon were hung in the closet and the shirt she wore to the salon was placed in the hamper. The blue pajama pants were also found in the hamper during the December 26th search warrant. (See Detective Grogan testimony)

Tuesday, December 24th, 2002

5:00am

Featured Fact:
Susan Medina, the neighbor across the street, sees Scott's truck in the driveway through her kitchen window. According to Scott, he would have been sleeping at this time. (See Susan Medina testimony)

7:00am

Scott said:
Scott estimated that Laci woke up around 7:00am.

8:00-8:30

Scott said:
Scott estimated he woke up between 8 and 8:30. He said Laci had already eaten cereal by the time he woke up. He said she ate right when she got up to avoid feeling sick. He said Laci ate toast with him while he ate cereal. Scott said the cereal was Cinnamon Puffins from Trader Joe's.

Sharon Rocha testified in the preliminary hearing that Laci had told her she needed to eat right when she woke up to avoid feeling sick.

8:40-8:45am

Scott said:
When Scott was asked by the police why a duffel bag was on the floor in the second bedroom, he said he had removed a pair of tennis shoes from the duffel bag and placed them on the bar outside.

Featured Facts:
The photos below show the duffle bag in question on the floor of the second bedroom, and the second picture show Scott's tennis shoes on the bar outside. Although difficult to see, the shoes are behind the case of water to the right of the leash.

Featured Fact:
It appears that Laci is on the computer at Scott and Laci's house. The MSN home page is accessed, a weather site from Yahoo! is accessed showing an extended forecast for the San Jose area, and two Yahoo! Shopping sites are accessed. One shopping site was for a GAP pro fleece scarf and a sunflower umbrella stand. Scott never mentioned this to anyone, it was revealed in trial. An analysis of Laci's typical computer use could have been done to determine if this was Laci or not, but Detective Wall was never asked by the investigators in charge to make this comparison. Scott said:
He made a morning decision to go fishing, it was too cold to golf. He said he had recently purchased a boat and wanted to get the boat in the water. When questioned about the fishing, he indicated he had previously searched the internet regarding fishing

Bruce Peterson testified that he had sold Scott a boat on December 9th. (See Bruce Peterson testimony)

Featured Fact:
Detective Wall testified that on December 8th, Scott used his home computer to search for information on fishing for sturgeon, to search for boating regulations, to search for Department of Fish and Game Rules and Regulations, and to search boat want ads. He printed out a page that day from a web-site called Captain Hooks Sportfishing. In all Scott's computer use there is only around 30 seconds total of material that contained any kind of charts for the San Francisco Bay (See Detective Wall testimony). Many news reports referred to these 30 seconds as "researching" the currents in the San Francisco Bay.

Featured Fact:
Scott had purchased a two day fishing license, which was dated for 12/23 and 12/24, and some lures at Big 5 on December 20th. (See Detective Grogan testimony)

Featured Fact:
At least eight people testified that Scott told them he had gone fishing on December 24th. This included Laci's family and many police officers. He also left Laci a message on her cell phone saying he was leaving the marina.

Note:
Three people testified that Scott told them he went golfing on December 24th; Amie Krigbaum, Terra Venable and Laci's mom's cousin's husband, Harvey Kemple. Amie and Terra are neighbors across the street. When Scott knocked on their door the evening of December 24th to see if they'd seen Laci, Amie asked Scott where he had been that day. She remembers him saying golfing. Terra testified that she was present when this conversation took place. Harvey went to the police in June of 2003, after Scott's arrest and said that Scott had told him six months earlier, on Christmas Eve night, that he had been golfing that day. If you want to read Harvey's testimony, he also says that Scott got upset over burning chicken on the fourth of July and slammed the lid of the barbeque down. Scott and Laci's barbeque didn't have a lid. How much weight do we give someone who comes forward six months later and lies on the stand? That leaves two women testifying to the same instance of Scott saying "golfing" and all law enforcement officers, all Laci's family (except allegedly Harvey) and all Laci's friends testifying that Scott said he went fishing. The fact is Scott never hid the fact he went fishing.

In a phone call with Sharon on December 28th, Scott said, "that she (Laci) looked so cute because she was sitting on her bench in front of the mirror styling her hair the way Amy had shown her."


Featured Facts:
This photo, taken the day she disappeared, shows Laci's curling iron on the bathroom counter with the cord extended toward the outlet which is near the toilet. The maid, Margarita Nava, who was there the day before, testified that Laci was up and dressed when she arrived and there was nothing out on the bathroom counter when she left. (See Margarita Nava testimony) In prosecutor Rick Distaso's rebuttal closing argument he said the curling iron was out because Laci took it to the salon with her the night before and came home and put it on the bathroom counter. Why is the cord stretched toward the outlet and why is the bench there?
