Tuesday, May 5. 2009Wrongful death lawsuit dropped... Last week the Rocha family quietly dropped the wrongful death lawsuit against Scott. The reality is, if this civil case would have gone forward, it would have given Scott's criminal conviction an even better chance of being overturned because of the amount of new information that would have been discovered and revealed. Part of this civil litigation would have included depositions. Civil depositions would have allowed our attorneys to question people under subpoena who would not otherwise cooperate with our investigation. This would have been critical because our investigators do not have the power to execute a search warrant, they do not have power to detain people for questioning, and they do not have power to subpoena records. We know that with each new piece of evidence that comes to light, it further shows Scott is innocent. We have the truth on our side and as stressful and difficult as the courtroom and media spotlight are, we were not afraid for this civil trial to move forward. The Peterson Family Trackbacks

I think the Rochas were afraid that people that saw Laci walking after Scott left were going to ask to take depositions that they saw her walking like Scott said she was going to do.I think the Rochas know deep down in their hearts that Scott did not kill Laci and Conner.I hope this is a sign that Scott will get a new trial and will be set free. I will be here to the very end keep on fighting Scott you have a lot of supporters god bless you and your family. All my love,Rhonda
Rhonda and everyone else, I also have believed from the start that Scott is innocent and will be exonerated one day, but I wish that process would hurry up. Every day he's behind bars means that time is passing by too quickly, when we are praying that his attorneys will get him out of jail. God Bless You Scott, and your family. We are praying for you.
As far as I am concerned it is very telling that the Rocha's dropped the civil suit. Fear of being wrong? I think it is possible because I know if my daughter was killed I would want to know everything, not just what local police wanted to spoon feed me and also the public. I would want the whole truth. Then again, if I eventually campaigned to have her husband convicted, and wrote a book about it, things might get complicated.
I pray Sharon finds peace. I also pray the appeal will give Scott Peterson his freedom. There was no evidence he killed his wife and unborn son.
Thanks for explaining what the newspapers and Rocha's would not. We find it odd that every story that involved your family or Scott,was blared across the headlines of every newspaper true or not. Now the Rocha's drop a 25 million dollar law suit and an article appears briefly and then disappears.
They certainly had to know depositions were coming or maybe they thought you all would fold beforehand and give them the "settlement" they wanted so badly. I wish they had wanted the truth to come out as much. What didn't come out this time, will the next time. Scott is innocent and as time goes by, more and more people are seeing the truth and supporting the fight for his freedom!
i also believe he is innocent and the crazy part about all of this is the person(S) who really did do it got away with murder and is sitting back laughing at everyone.that person can be sitting at laci's mothers kitchen table everyday....and they'll never know it.
Thank you for explaining this to us....since it was quickly and silently swept under the rug. I was totally shocked to hear that the Rocha family dropped the 25 million dollar law suit. The only heads or tails I can make out of this...is the Rocha's were afraid that this would indeed benefit Scott in his appeal....and decided to drop it.

be very careful with my radio show page. if you have been there you have seen a group of people that have been all over the internet trying to shut down specific charities, and radio shows and chat rooms. They do not seem to like people helping others and think if they talk enough smack on ppl it will work.. They actually hacked my show page on blogtalk radio along with a few others.. and in the last day or so they hacked into my talkshow page as well i have lost access to my show site.. im working with admin to fix this and prosecute those responsible.. but yes.. this weeks show if i can get on will be more about nancy francis i would love to talk to you about your experience with her so please email me.

I believe Scott is in jail right now because he cheated and we all know that deserves the DP ,right?? People are on your side! I pray for you and your family! May the truth come to light.

"You've been exonerated," his mother, Joyce House, told him, shaking him awake. "Took 'em long enough," he replied, after taking a moment to process the information. House, 47, spent 22 years on Tennessee death row for the rape and murder of his neighbor, Carolyn Muncey, in 1985. He left prison last year and was placed under house arrest after the U.S. Supreme Court ruled that new DNA evidence could have led a jury to acquit him. He was scheduled to be retried next month when Union County District Attorney Paul Phillips announced Tuesday that he filed a petition to drop all charges against House. In the petition, Phillips said he still believes House was involved in Muncey's death, but acknowledged the DNA evidence presented significant reasonable doubt. His mother received the news Tuesday morning in a phone call from an assistant to her son's lawyer. "At first, I couldn't believe it, but my mom wouldn't lie to me," House said in a telephone interview from their home in Crossville, Tennessee. "I didn't know what to think, there were so many times I thought they'd given up on me." House cleared of murder » His mother says the news didn't come as a huge surprise, after several DNA tests failed to match his DNA to samples found under Muncey's fingernails and on her clothes. "They say the wheels of justice turn mighty slow, but for them to turn this slow is ridiculous," she said. Her son also remains unimpressed with the justice system. "I never had any real feelings about the justice system until these idiots got a hold of me, and now it's very low," he said. "I can tell you truthfully that there's nothing I miss about prison." District Attorney Paul Phillips wrote in his petition this week that he still believes House could have been convicted again in a new trial, "but the new evidence (including the forensic examinations) raises a reasonable doubt that he acted alone and the possibility that others were involved in the crime." But Phillips noted the "substantial sentence" House has served as another reason for the charges being dropped now. The former death row inmate, who suffers from multiple sclerosis, moved in with his mother in July, after he was released on bail. His time out of prison appears to have buoyed his health. His mother says talking to him has helped sharpen his mind, and he now thinks faster and talks clearer than he did back in July. Yet his condition keeps his body confined to a wheelchair and his aspirations relatively modest. When he learned about his exoneration, his first concern was when he could remove the ankle bracelet that monitored him under house arrest, he says. Next up, he says he is looking forward to visiting his grandfather in California, who will celebrate his 90th birthday this summer. "I guess all I want to do is go out and see my grandpa, mom's dad," House said, giggling. "Grandpa's all right, I was named after him." He and his mother will make the cross-country drive in June to see his grandfather, who he last saw 10 years ago in a prison visit. The group will also stop in Arkansas to visit the grave of House's grandmother, who died while he was in prison. His exoneration also frees his mother, who had to make sure someone was in the home with him at all times, as part of the terms of his house arrest. "It was like we were both in prison," she said. "To go to the grocery store or get a haircut, I had to call someone, but the grocery store's 5 minutes away. The hardest thing was to call someone for 15 minutes. I felt like I was cutting into their day." Otherwise, House says his routine of watching his favorite game show, The Weakest Link, and eating his mother's delicious chili verde will remain mostly unchanged. "This gives me a life. The only life I had was prison life, and that was nothing to be happy about."
IMO, Sharon and Dennis Rocha dropped the lawsuit because they couldn't prove Scott's guilt. Guilt cannot be articulated.
Guilt was not proven in the criminal trial: The tapes won the case for the prosecution.
Funny how we heard nothing about this on the news. I only found out by coming to this site. They report about everything Scott does,like if he eats food,has visitors,gets mail ect but not one word about this. Hmmm very interesting to say the least.
This really isn't as silent as people say. Scott Peterson will still be discussed but this will be the cloud in every discussion. The Rocha's dropping the lawsuit is really telling to me. After 2 years of waiting, what was the conversation that made them widthdraw, especially at this point? Scott, you can start holding your breath because I'm confident you'll be home soon. Incoming donation of seventy-eight dollars (I got help one day and thats how much they gave me, I dont want to find out how much that is in today's money cause I really cant afford to give more) to help ease the time.
I am so glad to see that the suit was dropped as it was meritless. There is no way that Scott was responsible for anything but cheating. It amazes me still that that alone was the reason for his conviction. All evidence that was at the trial was circumstantial and heresay at best. Scott should be exonerated of all charges. I want to continue my support for the family, Scott and all those who believe that the only crime that was committed was that of investigators failing to see past Scott as the prime suspect. Be strong and keep up the fight.
I cannot believe that the papers will put every fabrication and other false information in the lime-light but not this!!! The news, the Rocha family, all of the "talk show" types, etc. were so quick to convict Scott, but did one of them report this??? NO! It only gives more credit to Scott's appeal! The Rocha's dropped the case because they are afraid of the "TRUTH"...they now need to face the fact that instead of looking for the murderer, they put all of their energies into convicting the wrong person! May Laci and Conner rest in peace and may Scott soon find freedom and be exonerated! God Bless!
Every year, on Christmas Eve, our family lights a candle for Laci and Connor at our church.
I don't believe Laci will rest in peace until her true murderer is caught, and her husband is exonerated. I also believe that whatever took place that day, had something to do with the robbery across the street. I am waiting for the day that Scott is granted a NEW trial, and everything, and I mean EVERYTHING comes out, and he is exonerated. |
